Decathlon Sports India Filed Trademark Infringement Suit against Pentathlon- NCR based sports

Decathlon India has filed an intellectual property (IP) law suit against NCR-based Pentathlon Sports. Decathlon says that its a legal action to stop Pentathlon Sports from unauthorised use of the registered trademark of the Plaintiff No I (Decathlon), selling counterfeits in the market and passing them off as goods of the Plaintiffs (Decathlon).

The complaintalsostates that Pentathlon haseven copied their trademark tagline “Sports for All / All for Sports”.Pentathlon has even used the same colour scheme and font for its trademark as Decathlon has. Moreover, Pentathlon has even italicised the same letter “A” in the name just like in the Decathlon trademark.Decathlon’s “Sports For All / All For Sports” is the same like Pentathlon’s “Sports for Everyone and Everyone for Sports” tagline. 

The concept of the Pentathlon as a name appears to be identical with Decathlon. Decathlon Sports India also stated in the law suit that Pentathlon Sports, which has three retail stores, in the NCR region, has caused them “irreparable loss”. 

In a statement, Decathlon stated, “This is a case of IP violation, we have taken appropriate legal remedial measures. As the matter is currently sub-judice, we are unable to provide any further details at this stage.”
